The joint parties have applied for a so-called emergency appeal. "We appeal because we believe that a sound basis", said the spokesman of KPN. Further iminformation was not given. However, it is obvious that the KMK questions the decision of the judge to apply the "Grossmann judgment". 'Grossmann' implies that the complaining party is too late with her concerns and that therefore the complaint is inadmissible.

By this judgment the court has never held a substantive assessment of the case.
